The three conditions
- At least one year of continuous service (365 days).
- 15 or more contracted hours a week on a 4-week average — part-time, fixed-term and foreign workers included.
- You were an employee: if the company directed and supervised your work, a “freelancer” label does not matter.
Deadline and late payment
- Severance is due within 14 days of leaving (Art. 9) unless both sides agree to a later date.
- Late payment accrues 20% annual interest, and you can file a wage-arrears petition with the Ministry of Employment and Labor.
